Terms of Service

Effective 2026-05-24. AI Ascend is operated by Sigmoid Technologies, Thiruvananthapuram, Kerala, India.

1. Acceptance

These Terms of Service ("Terms") form a binding agreement between you ("you", "User") and Sigmoid Technologies ("Company", "we", "us"), registered in Kerala, India. By creating an account, accessing, or using AI Ascend (the "Service"), you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. The Service

AI Ascend is an online learning platform offering structured content, AI-powered tutoring, flashcards, study plans, a hands-on machine-learning playground, and curated AI news. Features available to you depend on your subscription plan (Free, Pro, or Pro Max).

3. Eligibility & Accounts

• You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. Users between 13 and 17 may use the Service only with verifiable consent of a parent or legal guardian who agrees to these Terms.
• You agree to provide accurate information when creating an account and to keep it current.
• You are responsible for safeguarding your password and for all activity under your account. Notify us immediately at sigmoidtechnologies@gmail.com if you suspect unauthorized use.
• One account per person. Sharing credentials is grounds for termination.

4. Subscriptions, Payments, Refunds

• Paid plans are billed as one-time payments via Razorpay for a fixed term (typically twelve months). There is no automatic renewal; access reverts to the Free tier when the term ends unless you renew.
• All amounts are in Indian Rupees (INR) and inclusive or exclusive of GST as displayed at checkout. We issue a tax invoice within seven (7) days of capture.
• Refunds. You may request a full refund within seven (7) days of the original payment if you have not consumed substantial premium content (defined as completing more than three premium concepts, ten flashcard reviews, or twenty-five mentor messages in that period). Refund requests after this window are at our sole discretion. Email sigmoidtechnologies@gmail.com with the Razorpay order ID.
• Failed or disputed payments may result in immediate downgrade to the Free tier.

5. Acceptable Use

You agree NOT to:

• Use the Service for any unlawful purpose, or in violation of any applicable law or regulation, including the Information Technology Act, 2000 (India) and rules issued thereunder.
• Reverse-engineer, decompile, scrape at scale, or attempt to extract the underlying models, prompts, or proprietary content.
• Resell, sublicense, or redistribute Service content without prior written consent.
• Upload data to the ML Playground that contains personal data of third parties without their consent, or that you do not have the right to share.
• Use the AI mentor to generate content that is unlawful, harassing, defamatory, infringing, hateful, or that solicits or provides material that violates intellectual property or privacy rights.
• Attempt to circumvent rate limits, access controls, or payment requirements.

We may suspend or terminate access for violations of this section without refund.

6. Intellectual Property

• The Service, including all underlying software, written content, designs, logos, and trademarks, is owned by Sigmoid Technologies or its licensors and is protected by copyright, trademark, and other intellectual property laws.
• You retain ownership of content you submit (including ML Playground datasets and mentor chat messages). You grant us a non-exclusive, worldwide, royalty-free licence to host, store, process, and display that content solely as required to provide and improve the Service.
• AI-generated content returned to you (mentor replies, flashcard drafts, ML rationales) is provided to you for your personal or internal business use. You are responsible for verifying its accuracy before any reliance.

7. Third-Party Services

The Service uses third-party providers to deliver core functionality, including Anthropic (Claude), Groq, Resend (email), Razorpay (payments), and our hosting provider. Their handling of your data is described in our Privacy Policy. We are not responsible for outages or changes to their services.

8. Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose, accuracy, or non-infringement. AI-generated outputs are not professional advice (medical, legal, financial, or otherwise) and should not be relied upon as such.

9. Limitation of Liability

To the maximum extent permitted by law, Sigmoid Technologies, its directors, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Service. Our aggregate liability for any claim arising under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Sigmoid Technologies from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your violation of any law, or your infringement of any third-party right.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any breach of these Terms. You may stop using the Service at any time. Sections 6, 8, 9, 10, 12, and 13 survive termination.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at Thiruvananthapuram, Kerala, India.

13. Changes

We may revise these Terms from time to time. The "Effective" date at the top of this page reflects the most recent change. Material changes will be communicated by email or via an in-product notice at least seven (7) days before they take effect. Continued use after the effective date constitutes acceptance.
